TERMS AND CONDITIONS FOR PARTICIPATION IN THE ENUGU STATE YOUTH EMPOWERMENT PROGRAMME (E-YES)
Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the www.e-yes.en.gov.ng website operated the Enugu SME Centre under the Enugu Human Capital Development Loan Programme (“us”, “we”, or “our”).
Your access to and use of the website is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all participants who wish to register for the E-YES programme using this service.
1. Acceptance
By assessing and using this service, you accept and agree that you shall be bound by the terms and provisions of this Terms and Conditions Agreement. By submitting your application, you agree to comply with the Terms and Conditions. In addition, when using the E-YES programme, you shall be subject to any posted guidelines or rules applicable to the programme. Any participation in this programme will constitute acceptance of this agreement. In the event that you fail to comply with these Terms and Conditions for any reason whatsoever, you agree that your application shall not be eligible for consideration and shall be disqualified from the selection process. IF YOU DO NOT AGREE TO ABIDE BY THE TERMS AND CONDITIONS, PLEASE DO NOT SUBMIT ANY APPLICATION.
Eligibility Criteria
To be considered eligible for the E-YES programme, it is required that you meet the following criteria:
3. Selection Process
Upon submission of the online registration, we will screen the applicants and select those who best meet the criteria for the E-YES programme. As part of the selection process, there will be an online test for those who scale through the initial selection process. The required cut-off mark for the online test is eighty-five percent (85%). Those who meet the cut-off mark will proceed to the final stage of selection. This stage will be a video assessment. Those selected will be given certain questions and will record themselves answering the questions. The final selection will be based on this final stage. The successful candidates will be sent to the Enugu SME Centre to undergo the loan documentation process.
4. The Training
After the loan documentation process, the successful candidates will undergo the training for a period of four (4) weeks which will cover all areas of digital marketing including Social Media Marketing, Web Design and Development, Search Engine Optimization (SEO) and more.
Once the training has been completed, the training agency will provide jobs for a percentage of the trainees while the Enugu SME Centre will provide jobs for the rest.
If selected for this programme, you agree to give your undivided attention and best efforts to ensure that you learn what is required of you within the stipulated training period. You also acknowledge, accept and agree that this training is not free and that the Enugu SME Centre is providing a loan facility which grants you access to the training on the condition that the cost of the training will be repaid by you within six (6) to ten (10) months of completion of the programme.
You also agree that once selected for the training, you will not abandon the programme midway but will ensure that you follow through to completion. Failure to complete the programme will lead to forfeiture of the guarantor’s fee and any other action which the Government of Enugu State may choose to take against you to recover the loan.
5. Access to the Website and Participation in the E-YES Programme
To access this website and participate in the E-YES training, you will be required to provide certain registration details or other information. It is a condition for your registration that all the information you provide on the registration form on the website and to the Enugu SME Centre and its Agents will be correct, current and complete. If the Enugu SME Centre and its Agents believe that the information provided by you is incorrect, out dated or incomplete, Enugu SME Centre and its Agents has the right to refuse you access to the website, disqualify your registration for the training and terminate or suspend your access at any time. The Enugu SME Centre reserves the right to take further legal action against you for giving any false, incorrect, misleading or misrepresenting information during the registration.
6. Restrictions on Use
You may use this website to register for the E-YES programme. As a condition for your use of the website and registration, you warrant to Enugu SME Centre and its Agents that you will not use the website and registration for any purpose that is unlawful or prohibited by these Terms and Conditions. You warrant to Enugu SME Centre and its Agents that you will not serve as a registration agent to anyone to register them for a fee to be paid to you as the Enugu State SME has no registration agents. You may not modify, copy, distribute, display, send, perform, reproduce, publish, licence, create derivative works from, transfer or sell any information, content, software, products or services obtained from or otherwise connected to the website.
7. Waiver
All who register for this programme agree that we have the sole responsibility of determining those who are eligible for the programme by meeting the selection criteria. All who register also agree not to hold us liable where they fail to meet the selection criteria or where they fail to pass any of the selection process. All who register agree not to take any action in court where they fail to meet the criteria or are not selected to participate in the programme. We will ensure that the selection process is fair and based on merit without recourse to duress, pressure or financial inducements of any kind.
8. Proprietary Information
The material and content accessible from this website or any other website owned, operated, licensed or controlled by us is the proprietary information of the Enugu SME Centre and its Agents or the party that provided or licensed the content to us, whereby such providing party retains all rights, title and interest in the content. Accordingly, the content may not be copied, distributed republished, uploaded, posted or transmitted in any way without the prior written consent of Enugu SME Centre and its Agents. In doing so, you may not remove or alter, or cause to be removed or altered any copyright, trademark, service mark or any other proprietary notice or legend appearing on any of the content. Modification or use of the content except as expressly provided in these Terms and Conditions violates Enugu SME Centre and its Agents intellectual property, image and privacy rights. Neither title nor intellectual property rights are transferred to you by access to this website and in registering for the E-YES programme.

The site and all its original content are the sole property of Enugu SME Centre and are, as such, fully protected by the appropriate copyright and other intellectual property rights laws of the Federal Republic of Nigeria.

ENUGU SME CENTRE AND ITS AGENTS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, CONTENT PROVIDERS, EMPLOYEES, OFFICERS AND DIRECTORS WILL NOT BE LIABLE FOR ANY INCIDENTAL, DIRECT, INDIRECT, PUNITIVE, ACTUAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR OTHER DAMAGES INCLUDING LOSS OF REVENUE OR INCOME, PAIN AND SUFFERING, EMOTIONAL DISTRESS OR SIMILAR DAMAGES, EVEN IF ENUGU SME CENTRE AND ITS AGENTS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
ENUGU SME CENTRE AND ITS AGENTS WILL NOT BE LIABLE FOR FAILURE OF ANY PERSON TO SCALE THROUGH ANY OF THE SELECTION STAGES AS IT RESERVES THE RIGHT TO DETERMINE THOSE WHO ARE ELIGIBLE FOR THE PROGRAMME BASED ON THE INFORMATION SUBMITTED AT REGISTRATION.

Trademarks, service marks, and logos appearing in this website are the property of Enugu SME Centre and its Agents or the party that provided the trademark, service marks and logos to Enugu SME Centre and its Agents. Enugu SME Centre and its Agents and any party that provided trademarks, service marks and logos to Enugu SME Centre and its Agents retain all rights with respect to any of their respective trademarks, service marks and logos appearing in this website.

BY ACCEPTING THESE TERMS AND CONDITIONS AGREEMENT YOU WAIVE AND HOLD HARMLESS ENUGU SME CENTRE AND ITS AGENTS FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY ENUGU SME CENTRE AND ITS AGENTS DURING OR AS A RESULT OF ITS INVESTIGATIONS AND/OR FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER ENUGU SME CENTRE AND ITS AGENTS OR LAW ENFORCEMENT AUTHORITIES.

Enugu SME Centre reserves the right to terminate your access to the site without any advance notice.
If for any reason this programme is not capable of running as planned due to infection by computer virus, bugs, worms, trojan horses, denial of service, attacks, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of Enugu SME Centre that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this programme, the Centre reserves the right, at its sole discretion, to disqualify any individual(s) who tamper with the registration process, and/or to cancel, terminate, modify, or suspend this programme. If the Centre elects to cancel or terminate this programme, it will not retain any rights to the submitted applications.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.
19. Governing Law
These Terms and Conditions will be governed and interpreted pursuant to the laws of the Federal Republic of Nigeria, notwithstanding any principles of conflicts of law. You specifically consent to the jurisdiction of Federal Republic of Nigeria in connection with any dispute between you and Enugu SME Centre and its Agents arising out of these Terms and Conditions or pertaining to the subject matter hereof.
20. Changes to this Agreement
Enugu SME Centre reserves the right to modify these Terms of Service at any time. We do so by posting and drawing attention to the updated terms and site, your decision to continue to make use of the site after such changes have been made constitutes your formal acceptance of the new Terms of Service.
